Welcome to the Arts Development Council of Georgia Website!
1. The Arts Development Council of Georgia web site ("ADCG.org" or the "Site") is wholly owned by Arts Development Council of Georgia, Inc. ("ADCG, INC."), a Georgia not for profit, 501(c)3, corporation.
2. ADCG.org Information and Services
a. The ADCG.org web site offers information about members, sponsors, and patrons of the arts as well as news, classes and other general information about and of interest to Georgia artists and artisans. The information presented on the Site is copyrighted by Arts Development Council of Georgia, Inc or the members, sponsors or patrons whose information or products are represented on the Site.
b. By using the Site, you (the "user" or "you") agree to be bound by the following terms and conditions (the "Terms of Use" or the "Agreement"), including those available by hyperlink. If you have any questions, please refer to the Contact Us section of the Site.
c. In order to become an ADCG.org registered user, you must first become a member of the Arts Development Council of Georgia and agree to the Terms of Use. You may not become a registered user on ADCG.org if you do not accept the Terms of Use.
d. You can accept the Terms of Use by clicking to accept or agree to the Terms of Use, in any of several pages on the Site where the option is presented.
e. You may not purchase a membership from the Arts Development Council of Georgia or accept the Terms of Use if (a) you are not of legal age to form a binding contract with ADCG, Inc., or (b) you are a person barred from purchasing such products under the laws of the United States or other countries including the country in which you are a resident or would receive shipment.
f. The Agreement is effective on February 5, 2009 for current users, and upon acceptance for new users.
3. Your passwords and account security
a. You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with any account you use to access the Site.
b. Accordingly, you agree that you will be solely responsible to ADCG, Inc. for all activities that occur under your account.
c. If you become aware of any unauthorized use of your password or of your account, you agree to notify ADCG, Inc. through the Contact Us page on the Site.
4. Privacy and your personal information
a. For information about ADCG, Inc.'s data protection practices, please read ADCG, Inc.'s privacy policy at http://www.adcg.org/privacy. This policy explains how ADCG, Inc. treats your personal information, and protects your privacy, when you use the Site.
b. You agree to the use of your data in accordance with ADCG, Inc.'s privacy policies.
5. Content in the Site
a. You understand that all information (such as data files, written text, computer software, music, audio files or other sounds, photographs, videos or other images) which you may have access to as part of, or through your use of, the Site are the sole responsibility of, is owned by and is copyrighted as indicated by ADCG, Inc., or the members, sponsors or patrons represented on the Site.
b. Unless you have agreed otherwise in writing with ADCG, Inc., nothing in the Terms of Use gives you a right to use any of ADCG, Inc.'s trade names, trade marks, service marks, logos, domain names, and other distinctive brand features.
c. Unless you have been expressly authorized to do so in writing by ADCG, Inc., you agree that in using the Site, you will not use any trade mark, service mark, trade name, logo of any company or organization in a way that is likely or intended to cause confusion about the owner or authorized user of such marks, names or logos.
6. Copyright and trade mark policies
a. It is ADCG, Inc.'s policy to respond to notices of alleged copyright infringement that comply with applicable international intellectual property law (including, in the United States, the Digital Millennium Copyright Act) and to terminating the accounts of repeat infringers.
7. Other content
a. The Site may include hyperlinks to other web sites or content or resources. ADCG, Inc. may have no control over any web sites or resources which are provided by companies or persons other than ADCG, Inc.
b. You acknowledge and agree that ADCG, Inc. is not responsible for the availability of any such external sites or resources and does not endorse any advertising, products or other materials on or available from such web sites or resources.
c. You acknowledge and agree the ADCG, Inc. is not liable for any loss or damage which may be incurred by you as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such web sites or resources.
8. Changes to the Terms of Use
a. ADCG, Inc. may make changes to the Terms of Use from time to time. When these changes are made, ADCG, Inc. will make a new copy of the Terms of Use available at http://www.adcg.org/tou and any new additional terms will be made available to you from within, or through, the Site.
b. You understand and agree that if you use the Site after the date on which the Terms of Use have changed, ADCG, Inc. will treat your use as acceptance of the updated Terms of Use.
9. General Legal Terms
a. The Terms of Use constitute the whole legal agreement between you and ADCG, Inc. and govern your use of the Site (but excluding any services that ADCG, Inc. may provide to you under a separate written agreement), and completely replace any prior agreements between you and ADCG, Inc. in relation to the Site.
b. You agree that ADCG, Inc. may provide you with notices, including those regarding changes to the Terms of Use, by any currently available means including but not limited to email, regular mail, or postings on the Site.
c. You agree that if ADCG, Inc. does not exercise or enforce any legal right or remedy which is contained in the Terms of Use (or which ADCG, Inc. has the benefit of under any applicable law), this will not be taken to be a formal waiver of ADCG, Inc.'s rights and that those rights or remedies will still be available to ADCG, Inc.
d. If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms of Use is invalid, then that provision will be removed from the Terms of Use without affecting the rest of the Terms of Use. The remaining provisions of the Terms of Use will continue to be valid and enforceable.
e. The Terms of Use, and your relationship with ADCG, Inc. under the Terms of Use, shall be governed by the laws of the State of Georgia without regard to its conflict of laws provisions. You and ADCG, Inc. agree to submit to the exclusive jurisdiction of the courts located within the state of Georgia to resolve any legal matter arising from the Terms of Use. Notwithstanding this, you agree that ADCG, Inc. shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.
